Thirty minutes after a 20-year-old Cleveland man was released from jail Friday, police said the man celebrated his freedom by breaking into his ex-girlfriend's house and stabbing her boyfriend.
Cuyahoga County Common Pleas Judge Stuart Friedman found Miguel Hernandez not guilty June 11 on charges of kidnapping, aggravated robbery and felonious assault. He was accused of using a pipe to beat up another man.
Hernandez remained in jail on a separate charge of receiving stolen property. His attorney asked for a lower bond last week, and Friedman granted the request. After nearly four months behind bars, Hernandez left jail Friday about 3:30 p.m.
Great job Judge Stuie! And what did the Judge Stuie have to say for himself...
The judge declined to comment on what Hernandez did after his release. The evidence against Hernandez was weak on the kidnapping, aggravated robbery and felonious assault charges, and a co-defendant was found guilty on the charges, Friedman said.
"The evidence was insufficient to find Mr. Hernandez guilty," Friedman said.
The bond commission recommended a lower bond because Hernandez didn't have a prior record and was being held on a nonviolent offense.
"It would have been unconstitutional to not let him out," Friedman said.
Seems odd that the evidence was strong enough for Hernandez's co-defendant to be found guilty of the original charges, but Judge Stuie found Hernandez not guilty. After being told by prosecutors that Hernandez is a continual problem and presiding over a case that accused Hernandez of violent behavior - Judge Stuie felt he knew best!
Judge Stuie is known for a lack of rational decisions on the bench. Friedman has reduced domestic violence charges on a defendant previously convicted of domestic violence. Judge Stuie's reasoning - unless a couple is married - no domestic violence charges can be filed...

A judge has ruled that Ohio's new constitutional ban on gay marriage prohibits filing domestic violence charges against unmarried people, a decision that prompted an immediate appeal by prosecutors.
Judges and others across the country have been waiting for a ruling on how the gay marriage ban, among the nation's broadest, would affect Ohio's 25-year-old domestic violence law, which previously was not limited to married people.

Judge Friedman ran unopposed in 2006. Judge Stuie is running for 8th District Court of Appeals in this upcoming election against Republican candidate Brian Moriarty. The last thing we need is an activist judge like Friedman legislating from the bench of the Appeals Court!
