Child Porn found on O'Malley's Computer


Child pornography was found on computers that were in the possession of former Cuyahoga County Auditor Patrick O’Malley. But, O’Malley, who facing sentencing on obscenity charges next week was not charged with child pornography.

A recent court filing shows along with child pornography, stories & photos depicting violent sexual acts on children, rape, beastiality and sex with inanimate objects. Child pornography charges were not brought forward because authorities were concerned on the chain of custody on the computers. While O'Malley was going through a divorce, his ex-wife, Vicki O'Malley, turned the computers over to authorities - causing the concern over the chain of custody.

Details of the memo can be found by doing an Internet search. I will not link to the trash. Not because I do not want to offend anyone either. I will not link to it because I will not serve as an enabler for the pervs that get their rocks off on this crap.

Simply put…. although a complete, detailed and exhaustive investigation was done in documenting the users and who downloaded the questionable material, authorities were not convinced that they could prove, beyond a reasonable doubt, that it was specifically O’Malley.

So you can either buy that excuse or, like me, think he may be trading information on the corruption probe in exchange for not being charged with more serious crimes and hopefully receive a minimum sentence on his obscenity charges.

The memorandum states that the divorce proceeding between O'Malley and his wife "was quite public and quite volatile" and that while "the forensic examinations seemed to authenticate the evidence of child pornography, it was clear that the chain of custody for all such evidence included (Vicki) O'Malley, her attorney and their investigator."

"As the father of five children, Defendant sought out and received, for over six and one half years, numerous stories glorifying and salaciously describing sex between adults and children, including children who would have mirrored his own children's ages," the memorandum states. "... The scope and depravity of the material Defendant sought is made exceedingly more disturbing by the fact that he was the custodial parent of small children at the time."

The prosecution is asking the judge to sentence O'Malley to the maximum limit of five years in prison. Guideline levels related to the plea agreement call for a lesser sentence, but that's just one factor the judge will consider. More...
